A recent probate involved obtaining a specialist Grant of Probate to deal with the sale of shares in a company owned by the deceased. The original Executor had lost capacity and their attorney under a registered Lasting Power of Attorney was dealing with the sale of the shares. The attorney was not able to act under the existing Grant of Probate and a specialist Grant of Probate had to be obtained in order for the attorney to be the personal representative of the deceased and sell the shares in the company.
